1. Ordering

All items ordered by you are for your own personal and non-commercial use only.

You are eighteen years or older. If you are under eighteen, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this site.

All details you provide to Flaxfield for the purpose of ordering or purchasing goods must be true, accurate, current and complete in all respects; and the credit or debit card you are using must be your own.

You agree that email can be used as a long-distance means of communication.

Flaxfield will not be liable to you for your loss or that of any third party for a delay or failure to process, fulfil or deliver Items to you (or your nominated recipient) as a result of inaccurate or incomplete personal details provided in an order by you.

Once you submit your order, cancellations of your order or changes to the items in your order cannot be made, unless by agreement with Flaxfield. However, you can return items under the Returns Policy. You should check your Order carefully before submitting it.

If we reject an Order, we will notify you of the reason for rejection via email or phone as soon as reasonably practicable. Flaxfield will not be liable to you for your loss or that of any third party for the rejection of an order. If we reject an order and your payment for the items has already been processed, we will refund any money paid to us in respect of that order.

2. Availability of Items

From time to time, some Items on the Site may be unavailable and we may not be able to fulfil all or part of your order. If this happens, we will refund you the price paid for the relevant items.

If your order is affected by a genuine error (including in a description, image or a price), we reserve the right to cancel your Order and refund any money paid to us.

You acknowledge and agree that:

i. all pictures and images of the items displayed are for illustrative purposes only;
ii. any accessory featured with an Item is for illustrative purposes only, and may be sold separately; and
iii. where we provide dimensions and measurements in the description of an item, the dimensions may vary slightly in real life, and it is your responsibility to ensure that the actual size of each item is suitable for your purpose prior to submitting your order.

3. Price and payment

When you place an order, we will charge you and you agree to pay the price and any applicable delivery fees.

If your delivery address is outside Australia, you may have to pay import duties and taxes, which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance. Please note, customs policies vary widely from country to country. We recommend you contact your local customs office for further information. Please note international shipments may be subject to cross-border inspections by customs authorities.

You can pay for your items by any of the methods specified on the order form on the site, including credit card and Pay Pal. The name on the credit card used for the payment must match the name on the Order. All prices quoted are in Australian Dollars unless specified.

Any payment for an Order must be cleared by Flaxfield before items are despatched. If your payment cannot be processed, your order will be rejected. If a credit card payment cannot be processed you should contact your card issuer first to try to resolve the problem, or use an alternative payment method.

In paying or attempting to pay for items, you agree that you have not engaged in any fraudulent conduct or contravened any Law.

4. Delivery

The delivery period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock.

During major outlet sales events, orders may experience delivery delays.

In the event that your order does not arrive within the approximate delivery period stated we will do our best to assist in tracking your order. In the event of non-delivery of your order we are unable to process a replacement order until 21 business days following the original shipment date.

Once your items have been delivered, you must inspect the items and ensure the items delivered match your order. You must let us know about any damaged, missing and incorrect items as soon as possible by contacting shop@flaxfieldlinen.com

5. Order cancellations and Returns

If you haven’t submitted an order, you may clear a product in your shopping cart at any time by clicking the ‘Remove’ button next to it.

If you have submitted your order and received a confirmation email from Flaxfield you can still cancel your order within 12 hours of the order being placed. Please email your cancellation marked ‘URGENT CANCELLATION’ to shop@flaxfieldlinen.com and list your name, address, product ordered and order code on the email.

If you wish to cancel your order after more than 12 hours of the order being placed, you will need to wait until you receive the product and then follow our Returns procedure. You’ll find more information about this in our Delivery and Returns page.

Once we’ve heard from you that you wish to cancel an order, any sum debited to us from your credit or debit card will be re-credited to that credit or debit account within 30 days of your order, provided the goods you return are in the same condition that they were when delivered to you. You will be liable for any charges incurred when returning the goods to Flaxfield, unless the return is as a result of an error on our side.

6. Promotions and Discounts

You may receive online offers and promotions emailed to you, which include a promotional code for use when shopping on our site. It is your responsibility to ensure the code is valid, and that you enter the code at the time of placing an Order. We cannot apply the code after you have submitted your order. Separate terms may apply to the use of the code. Please read these carefully to make sure they apply to your purchase from Flaxfield. Any code is non-transferable and may not be used in conjunction with other offers.

All references to times in promotions are based on the local time in Sydney, Australia, unless stated otherwise.

7. Gift Vouchers

Gift Vouchers cannot be used for the payment of credit accounts. Gift Vouchers are not redeemable for cash and cannot be exchanged.

Gift Vouchers expire 12 months from the issue date, which is the date on which Flaxfield issued the Gift Voucher and not the date you received the Gift Voucher. Any unused amount after the expiry date of the Gift Voucher will not be refunded or credited.

8. Privacy

Personal Information, such as contact details, that you provide to us during the Order process will be kept and used by us under Flaxfield’ Privacy Policy.

9 Risk & Liability

Risk and title in the items passes to you on the date and time of delivery of the items.

Flaxfield's total liability for any claim, however it arises, will not exceed the price of the goods supplied by Flaxfield Linen to the customer, together with any postage costs incurred. Flaxfield Linen will not be liable for any resulting customer loss, whether this arises from a breach of duty in contract or in any other way.

Flaxfield cannot accept any liability for a failure to comply with specific instructions stated in a catalogue or on the website.

Our items come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Flaxfield may provide an additional warranty in addition to your Consumer Law rights and remedies. Any warranties given by Flaxfield provide you with benefits in addition to the Australian Consumer Law rights and remedies. When provided, the warranty period, provisions and the person providing the warranty relating to your purchase vary according to the product you have purchased.

Flaxfield excludes to the fullest extent possible under Law, all implied terms and warranties whether statutory or otherwise, relating to the subject matter of these Terms.

You represent and warrant to Flaxfield that Flaxfield will not be liable for any expense or injury (including indirect loss such as loss of revenue, profits, anticipated savings, goodwill or business opportunity, injury to your reputation) in contract, tort, under statue or otherwise, howsoever caused including arising directly or indirectly from or in connection with these Terms.

Our liability to you for loss or damage of any kind arising out of these Terms and Conditions will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.

10. General

Flaxfield reserves the right at all times to make changes to these Terms and Conditions. Any variations to will take effect from posting on the Site. The Terms and Conditions which apply at the time of order are those that govern your relationship with Flaxfield with respect to that Order.

Any provision of these Terms and Conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not void the remaining provisions of these Terms and Conditions or affect the validity or enforceability of that provision in any other jurisdiction.

A failure or delay by Flaxfield to exercise a power or right under these Terms and Conditions does not constitute as a waiver of that power or right, and the exercise of a power or right by Flaxfield does not preclude its future exercise or the exercise of any power or right.

The laws of New South Wales, Australia govern this agreement. Your transaction is deemed to have taken place in Sydney, New South Wales.

All rights, including copyright, in the content of the flaxfieldlinen.com web pages are owned or controlled by Flaxfield. In accessing flaxfieldlinen.com web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit or play in public, adapt or change in any way the content of the flaxfieldlinen.com web pages for any other purpose whatsoever without the prior written permission of Flaxfield Linen.
